<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">The right to enter one’s country of nationality is a basic human right guaranteed under Article 12 of the International Convention of Civil and Political Rights (ICCPR) and Protocol 4 of the European Convention of Human Rights (ECHR). It is clear that HM Government is aware that the UK is currently <strong style="mso-bidi-font-weight: normal;">in breach </strong>of these human rights instruments, as it has admitted that “<strong style="mso-bidi-font-weight: normal;"><em style="mso-bidi-font-style: normal;">in the absence of any change</em></strong><em style="mso-bidi-font-style: normal;"> in the arrangements for issuing British passports and the relevant provisions of our immigration legislation, it is <strong style="mso-bidi-font-weight: normal;">not possible to ratify</strong></em>”<span class="MsoFootnoteReference"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[1]</span></span></span></span></span> Protocol 4 of the ECHR. </span></p>
<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">However, although the UK has signed these human rights instruments more than 30 years ago and HM Government is aware that legislative changes are necessary, it is appalling that HM Government is “<strong style="mso-bidi-font-weight: normal;"><em style="mso-bidi-font-style: normal;">not</em></strong><em style="mso-bidi-font-style: normal;"> proposing to make any changes in relation to the status of British nationals</em>”<span class="MsoFootnoteReference"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[2]</span></span></span></span></span> and thus have decided to <strong style="mso-bidi-font-weight: normal;">continue violating the human rights </strong>of its<strong style="mso-bidi-font-weight: normal;"> own nationals</strong> by denying them entry into the UK. To add insult to injury, more than 400 million European citizens are already guaranteed these very same rights to live and work in the UK under EU treaties, which have been present since the 1970s. Given that these rights are already enjoyed by hundreds of millions of <strong>foreign</strong> nationals, there is no justifiable reason for the UK to continue to deny these rights to <strong>British</strong> nationals, whose number is far <strong>less</strong> than the number of European citizens. Therefore, it would only seem logical to make <span style="mso-bidi-font-weight: bold;">immediate</span> legislative changes to restore the rights for <strong>all</strong> British nationals to enter the UK.</span></p>
<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><strong style="mso-bidi-font-weight: normal;"><span style="text-decoration: underline;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">2) Racial discrimination</span></span></strong></p>
<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">Furthermore, all British nationals were previously able to enter the UK without subject to immigration control. But the British Nationality Act 1981 and its subsequent amendments, which separated British nationals into six categories, has forcibly removed the right of various British nationals to enter the UK, and have been heavily criticised as being racially discriminatory. As described by Anne Dummett, the overall “<em>effect [of these categories] is </em><strong><em style="mso-bidi-font-style: normal;">to give full British citizenship to a group of whom at least 96% are white people, and the other four forms of nationality to groups who are at least 98% non-white.</em></strong><span style="mso-bidi-font-weight: bold;">”<span class="MsoFootnoteReference"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-font-weight: bold; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[3]</span></span></span></span></span> This inherent race discrimination is also</span> reiterated in Lord Goldsmith’s recent Citizenship Review: “<em style="mso-bidi-font-style: normal;">In the past the different categories [of British Nationality] have created much unhappiness particularly as the concepts of “patriality” were seen <strong style="mso-bidi-font-weight: normal;">as a way of discriminating between white and black members of overseas communities.</strong></em>”<span class="MsoFootnoteReference"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[4]</span></span></span></span></span> In addition, both the European Commission of Human Rights and the UN Committee on the Elimination of Racial Discrimination have criticised aspects of the UK’s different categories of British nationality as containing elements of race discrimination.<span class="MsoFootnoteReference"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[5]</span></span></span></span></span></span><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt;" lang="EN-US">,</span></span><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt;" lang="EN-US"> </span><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[6]</span></span></span></span></span></span><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt;"> </span><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">Given this race discrimination in the UK’s nationality laws, I strongly encourage you to include changes in the Bill to remove racial discrimination in the categories of British nationality.</span></p>
<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><strong style="mso-bidi-font-weight: normal;"><span style="text-decoration: underline;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">3) No barriers to restoring human rights and removing racial discrimination</span></span></strong></p>
<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">In relation to a question on whether the Bill will redress any race discrimination in the UK’s nationality laws, HM Government recently claimed that “<em style="mso-bidi-font-style: normal;">there are particular legal reasons why we need to retain the category of British National (Overseas) with links to Hong Kong, because of our treaty commitments</em>.<em style="mso-bidi-font-style: normal;">”</em> However, this is factually incorrect and entirely misleading. </span></p>
<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB; mso-bidi-font-style: italic;">It has long been concluded by the parliamentary Foreign Affairs Committee in a report on Hong Kong in 1989 that <em>“<strong style="mso-bidi-font-weight: normal;">to grant full British Citizenship</strong>, however, would contradict the<span style="mso-bidi-font-weight: bold;"> British </span><strong style="mso-bidi-font-weight: normal;">memorandum</strong> <strong style="mso-bidi-font-weight: normal;">on nationality</strong> attached to the Joint Declaration. <span style="mso-bidi-font-weight: bold;">This memorandum is </span><strong style="mso-bidi-font-weight: normal;">not part of the Joint Declaration</strong><span style="mso-bidi-font-weight: bold;"> and to go against it<strong> would not constitute a breach of the Treaty.</strong></span>”<span class="MsoFootnoteReference"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><strong style="mso-bidi-font-weight: normal;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[7]</span></span></strong></span></span></span> </em>As testament to this, various laws since then have granted certain British Nationals (Overseas) an entitlement to register as full British citizens – the British Nationality (Hong Kong) Act 1990, British Nationality (Hong Kong) Act 1997 etc – <strong style="mso-bidi-font-weight: normal;">none</strong> of which have breached the Joint Declaration on the future of Hong Kong. Thus, it is clear that granting full British citizenship to British Nationals (Overseas) will not breach any international treaty. </span><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">In the review, Lord Goldsmith stated that:<em style="mso-bidi-font-style: normal;"> “<span style="mso-bidi-font-style: italic;">The only option which would be characterized as fair would be <strong style="mso-bidi-font-weight: normal;">to offer existing BN(O) holders the right to gain full British citizenship</strong>. It is likely that many would not take this up as the prospects economic and fiscal of moving to the UK are not favourable to those well-established in Hong Kong</span></em><span style="mso-bidi-font-style: italic;">.”<span class="MsoFootnoteReference"><span style="mso-special-character: footnote;"><span class="MsoFootnoteReference"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-fareast-font-family: PMingLiU; mso-ansi-language: EN-GB; mso-fareast-language: ZH-CN; mso-bidi-font-style: italic; mso-bidi-language: AR-SA;"><span style="color: #0000ff;">[8]</span></span></span></span></span> In fact, given the UK has signed Protocol 4 of the ECHR and have ratified the ICCPR and various treaties on anti-discrimination, the UK would be <strong style="mso-bidi-font-weight: normal;">in breach of its obligation under these international instruments</strong> by <strong style="mso-bidi-font-weight: normal;">not</strong> granting equal citizenship rights i.e. full British citizenship and the right to enter the UK to all British nationals.</span> </span></p>
<p class="MsoNormal" style="text-justify: inter-ideograph; text-align: justify; margin: 0cm 0cm 10pt;"><span style="line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; font-size: 12pt; mso-ansi-language: EN-GB;">Therefore, I strongly urge the UK to make the necessary changes in the Borders, Citizenship and Immigration Bill to allow all British nationals an entitlement to be registered unconditionally as full British citizens, in order to restore these basic human rights to all British nationals and to remove the blatant racial discrimination in the UK’s nationality and immigration legislation. </span></p>

<p class="MsoNormal" style="margin: 0cm 0cm 6pt;"><span style="line-height: 115%; font-size: 10.5pt;"><span style="font-family: Calibri;">As I am aware, the Immigration and Citizenship Bill is a follow-up of the review on British citizenship conducted by Lord Goldsmith, as requested by the Prime Minister in July 2007. One of the key points of Lord Goldsmith’s review was “to consider the difference between the different categories of British nationality.” However, it is apparent that the question of the different categories of British nationality has not been addressed in the Bill at all.</span></span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 6pt;"><span style="line-height: 115%; font-size: 10.5pt;"><span style="font-family: Calibri;">1. <span style="mso-tab-count: 1;">           </span>Protocol 4 to the European Convention of Human Rights and Article 12 of the International Convention on Civil and Political Rights guarantees the right of nationals to enter their country of nationality. Despite the UK being a signatory to these human rights instruments, British nationals who are not full British citizens do not currently have a right to enter the UK. It is disappointing that the current government appears to have no intention to take steps to forward these rights in the new Bill (House of Lords &#8211; Question HL349). This is despite the fact that EU laws already allow several million European Union citizens to live and work freely in the UK.</span></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 6pt; mso-para-margin-bottom: .5gd;"><span style="line-height: 115%; font-size: 10.5pt;"><span style="font-family: Calibri;">2.<span style="mso-tab-count: 1;">            </span>The Citizenship Review report <span style="color: black; mso-bidi-font-weight: bold;">prepared by</span> Lord Goldsmith has recommended that all British nationals should be given an entitlement to register as full British citizens to reduce the number of British nationalities and also so that equal rights are accorded to all British nationals. It also mentioned that British nationals <span style="mso-bidi-font-weight: bold;">are unlikely to move to the UK even if given full British citizenship, as most are well-settled overseas. The new Bill will be an excellent chance to put these recommendations into place and to restore full citizenship rights to all British nationals. </span></span></span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 6pt;"><span style="line-height: 115%; font-size: 10.5pt;"><span style="font-family: Calibri;">3.<span style="mso-tab-count: 1;">            </span>While all British nationals previously had the rights to enter the UK, the removal of these rights and the segregation of British nationals in the 1960s to 1980s were based heavily on ethnic origin. According to Ann Dummett, a prominent writer on British Nationality Law, “the 1981 Nationality Act in effect gave full British citizenship to a group of whom at least 96% are <strong style="mso-bidi-font-weight: normal;"><em style="mso-bidi-font-style: normal;">white</em></strong> people, and the other, less favourable forms of British nationality to groups who are at least 98% <strong style="mso-bidi-font-weight: normal;"><em style="mso-bidi-font-style: normal;">non-white</em></strong>”. It is unacceptable that such blatantly racially discriminatory policies still exist in modern day Britain. Again, the new Bill will be an excellent opportunity to correct this clear racism in Britain’s nationality and immigration laws.</span></span></p>

British National (Overseas), mainly the British Nationals from the former British Dependent Territory of Hong Kong are giving another sign of getting full British Citizenship in the future. This time, the UK government is consulting with The Joint Committee on Human Rights to adopt Bill of Rights for the UK.<br />
This possible Bill of Rights is meant to replace the entire Human Right Act, to fit the United Kingdom into the European Community (EC) in the model of 21st century.</p>
<p>&#8220;We are extremely pleased to hear this development. We believe that there is a strong case for&#8230; all British Nationals who are not the citizen of this country to get our basic rights back, such as Right of Abode or Full Citizenship,&#8221; said Robin Tso, Founder of BritishHongKong. &#8220;Our recommendation letter has been placed into the Written Evidence #4 in the Joint Committee on Human Rights. We are looking forward for the upcoming debates in the Parliament.&#8221;</p>
<p>According to the EU Treaty Article 17: Every person holding the nationality of a Member State shall be a citizen of the Union . Citizenship of the Union shall complement and not replace national citizenship. Citizen of the Union shall enjoy the rights conferred by this Treaty and shall be subject to the duties imposed thereby. The UK 1982 Declaration had excluded a lot of loyal British Nationals for the Purpose of Community Law.</p>
<p>&#8220;Given the trend of recent developments, we are faithful that our country is looking forward to ratify the Protocol 4 of European Convention on Human Right. The principle of international law suggusts that you have an effective nationality, you must have the right to at least enter one territory on the basis of that nationality.&#8221;</p>
<p>Her Majesty&#8217;s Loyal Opposition Party, the Conservative Party in the Parliament of the United Kingdom is also concerned on this situation.</p>
<p>&#8220;I believe that British Nationals (Overseas), particularly those from Hong Kong, should be able to register for British Citizenship. I also find it deeply concerning that EEA Nationals have the right to enter, work or study in the United Kingdom, whilst those British National (Overseas) do not,&#8221; said Andrew Rosindell MP, Shadow Minister of Home Affairs in the Conservative Party.</p>
<p>The idea of a Bill of Rights is at the heart of Prime Minister Gordon Brown&#8217;s plans to reform Britain&#8217;s constitution. BritishHongKong, had a petition to the PM Gordon Brown.</p>

<p class="Default" style="margin: 0cm 0cm 0pt;"><span style="font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;"><span style="font-size: small;">BritishHongKong would also like to point out that this memorandum was made by the HM government of the time with no consultation with the people of Hong Kong, and with, what we believed, the discriminatory aim of stopping the possible migration of these British Nationals to the UK after the handover of Hong Kong if the Right of Abode was granted. <span style="mso-spacerun: yes;"> </span>As Lord Goldsmith has indicated in the Citizenship Review report, given the high standard of living and economic prosperity in Hong Kong, if full British Citizenship is granted to BN(O)s, the likelihood of these people taking up their right to move to the UK would be minimal.</span></span></p>

<p class="Default" style="margin: 0cm 0cm 0pt;"><span style="font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;"><span style="font-size: small;">Our organisation appreciates the positive attitude of the HM government towards such matter, and also the research found in the Citizenship Review report. <span style="mso-spacerun: yes;"> </span>BritishHongKong will gather its Core Group members to urge the HM government to keep the promises made in the Joint-Declaration, by keeping the status of British National (Overseas) and also by giving BN(O) an equal and fair treatment. <span style="mso-spacerun: yes;"> </span>However, in order to avoid any breach of human right that may result after the ratification of The Treaty of Lisbon, BritishHongKong would like to express our concern to the Prime Minister, the Rt Hon. Gordon Brown MP, with the following recommendations:</span></span></p>

<p class="MsoNormal" style="margin: 0cm 0cm 10pt;"><span style="font-family: Calibri;"><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;">In the past, various groups of British Nationals (Overseas) have been granted full British Citizenship (and with it, the Right of Abode). In fact the HM Government, in the early 1990s, had given 50,000 families in Hong Kong full British Citizenship through the British Nationality Selection Scheme (under the British Nationality (Hong Kong) Act 1990 and also many others through the provisions of the British Nationality Act (Hong Kong) 1997, both of which has not breached the Memorandum of Sino-British Joint Declaration</span><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.0pt;"> the </span><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;">Government of the United Kingdom declared.<span style="mso-spacerun: yes;">  </span>The recommendation No. 2 above (BN(O) + BC) </span><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.0pt;">has been used before</span><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;"> (in granting British Overseas Territories Citizens access to full British Citizenship through the British Overseas Territories Act 2002) </span><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.0pt;">and this should not breach the Joint Declaration as well</span><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;">.</span></span></p>
<p class="MsoNormal" style="margin: 0cm 0cm 10pt;"><span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;"><span style="font-family: Calibri;">BritishHongKong also welcome Lord Goldsmith&#8217;s mention of Protocol 4 of the European Convention of Human Rights (ECHR) in his Citizenship Review. According to Protocol 4, persons should have a right to enter one&#8217;s country of nationality. However, certain categories of British nationals currently do not enjoy the right to enter the UK. The UK has signed the protocol in 1964, and is currently one out of three EU countries not to have ratified this protocol. As suggested by Lord Goldsmith, it would be timely to consider addressing these human rights issues with the current review of Citizenship laws and with the view of ratifying Protocol 4 of the ECHR.<span style="font-size: 12pt; line-height: 115%; mso-bidi-font-size: 11.5pt; mso-bidi-font-family: Calibri;"><span style="font-family: Calibri;">We would also like to thank Lord Goldsmith for exploring the rights of the different types of British nationals and that of Commonwealth, Irish and EU citizens in the UK in his review. His report has helped highlight the ironic situation at present, where certain British nationals enjoy less rights in the UK than certain foreign nationals, e.g. the right to enter, work or study freely in the UK and which are enjoyed by EU citizens but are not currently enjoyed by certain British nationals.</p>
